All bookings are subject to these conditions which are deemed to have been accepted in full by the renter and by all persons in the party.
A deposit of 50% of the total cost is required to secure your booking and the remaining balance is due 30 days prior to arrival. Some reservations require full payment upfront. Non-payment of any balance constitutes an immediate cancellation. Rates are subject to change without prior notice. Rates quoted are subject to availability. All extra service costs are to be settled prior to departure.
Cancellation Policy: In the event of cancellations made more than 90 days prior to arrival date, 30% of the total booking is forfeited. Cancellations made between 30 and 90 days prior to arrival date, 50% of total booking is forfeited. Cancellations made less than 30 days prior to arrival date, 100% of the total booking is forfeited.
Alterations and Cancellations by us: In the unlikely event that the villa, cottage or apartment becomes unavailable due to circumstances beyond our control we will offer you a refund of monies paid at that time. Any refund is restricted to the villa/apt rental costs and we are not liable for any cancellation or administration charges for travel arrangements or other agents etc.
Price excludes: Meals, wine and beer, taxi transfers, tours, personal, travel and cancellation insurance etc. Stays exceeding 30 days will be billed for electricity usage. Electricity is capped at R150 per day for stays less than 30 days; usage over and above the capped amount provided upon arrival will be for the guests’ direct expense.
Occupancy: You must let us know the number of persons who will occupy the villa or rooms at the time of booking. Copies of identification is required to arrange for security access if you wish to add further individuals you may only do so by prior arrangement with us.
Arrival/Departure: Check In 14:00 – 18:00 Check Out 08:00 – 10:00. Check-ins after 18:00 is subject to a fee of R300 and payable on arrival.
Damage: Except in the case of normal wear and tear you will be responsible for making good any damage to the villa, apartment or its contents, or to the swimming pool, jacuzzi or any exterior features which has occurred due to negligence or irresponsible behaviour on the part of those occupying the property or their guests. Such damage must be immediately reported. Damages will be deducted from your security deposit. Please supervise your children at all times, especially on the terrace, and the pool (where applicable).
Swimming Pool/Hot Tub/Jacuzzi: Use of swimming pools/hot tubs and jacuzzi is at your own risk. Diving is discouraged. Please use ‘swimmer’ nappies for infants under three and supervise your children at all time around the swimming pool. To ensure privacy, guests occupying the villa/apartment are not entitled to use the swimming pool unless they are members of the party also renting the villa/apartment.
Our liability: The premises are entered at your own risk. We are not responsible for any personal injury, illness, death, loss or damage of whatever nature suffered by you or by any member of your party, directly or indirectly, during the booking period, before or thereafter. This includes injury or harm while using the swimming pool/jacuzzi/gym, injury or harm from plants or animals in the garden, drinking water from the taps and use of the wood burning stove and gas heaters. We are not responsible for any mechanical breakdown and cannot guarantee the correct/continuous functioning of the internet connection, DSTV, DVD player, TV, stereo system, elevator, garage door, alarm, safe, appliances, plumbing, water, electricity, pool, shutters, heating, air conditioning or any other equipment. We advise drinking bottled water throughout your stay.
Keys will be provided and must be returned upon departure. Failure to return ALL keys given will be billed accordingly for the replacement of all keys as well as all locks, remotes, tags, alarm reprogramming, door/gate reprogramming and an administration fee. The minimum cost of replacement is R10 000.
Building Work: In the event of building works taking place by local authorities, private developers or neighbors, we are unable to stop such work taking place and are unable to control the level of noise.
Force Majeure: We regret that we cannot accept liability or pay any compensation where the performance or prompt performance of our contractual obligations is prevented or affected by ‘force majeure’. In these Terms and Conditions, ‘force majeure’ means any event which we or the supplier of the service(s) in question could not, even with due care, foresee or avoid. Such events may include, but are not limited to, war, threat of war, civil commotion or strife, political riots hostilities, strikes or other industrial disputes, load shedding, natural disasters, fire, acts of God, terrorist activities, quarantine, epidemics, pandemics, weather conditions, closure of airports, water shortages, power failures, government action or other events outside our control.
Insurance: The villa/cottage/apartment rental cost does not include insurance cover. We strongly recommend that you take out cancellation insurance, personal accident and medical insurance, vehicle rental insurance, property damage insurance and personal property insurance at the time of booking. No personal possessions of renters of whatever nature is covered for any loss or otherwise. You therefore acknowledge that you have provided for adequate and a fully comprehensive travel insurance policy including cancellation cover, cover for theft of personal belongings as well as rental vehicle insurance and that you are aware of the consequences of a lack in insurance cover.
The villa/apartment has a no smoking and no pet policy. Penalties (R5000) will be charged as well as the appropriate fees for cleaning of odour and dander. Failure to adhere to these rules could result in immediate eviction from the premises without compensation for the remaining days of the stay.
Some properties are subject to rules and regulations from the respective Home Owner Associations and need to be adhered to. Failure to adhere to the rules set out by the owner or HOA; will result in immediate eviction without compensation.
All occupants must behave in a manner that is considerate to others. Disruptive behaviour caused by loud music and/or late night or early morning rowdiness will not be tolerated. Should the occupants cause unreasonable annoyance, noise, distress, damage, crime or danger, the owner/agent has the right to evict the guest immediately and without compensation.
All credit card transactions for additional services offered outside of the booking platform will be subject to a 4% processing fee unless otherwise specified.
If there is an exceeding amount of guests staying overnight; more than the number of guests permitted on the premises, the guests/tenants will be charged an additional fee for each night the number was exceeded and will thereafter be asked to vacate the premises to return the guest count to the allowed number. Day visitors are limited to two guests. We strongly advise all guests to make use of safes (where provided). The owners and any other party employed by the owners cannot be held liable for any loss/theft etc.
The person booking the reservation books on behalf of all guests residing during the rental period at the property rented. This includes any/all day visitors that enter the premises.
The alarm must be activated at all times when the property is not occupied and the exterior beams activated when sleeping at night. Failure to do so might result in the guests/tenants being liable for all damages/theft which might occur at the property in the event of a break-in/theft.
You are aware that the existence of the risk of your physical presence at the Villa/Apartment that may cause injury or illness such as, but not limited to influenza, MRSA, or COVID-19 or any mutation or derivative that may lead to serious illness, paralysis or death. You are personally responsible for your own safety and actions during your stay. With full knowledge of the risks involved, you hereby release, waive, discharge the accommodation (Villa/Apartment), employees, representatives, contractors and assign from any and all liabilities, claims, demands, actions and causes of action whatsoever, directly or indirectly arising out of or related to any loss, damage, injury, or death that may be sustained by me related to COVID-19 while participating in any activity while in, on, or around the property or while using the facilities that may lead to unintentional exposure or harm due to COVID-19. You agree to indemnify, defend, and hold harmless the accommodation (Villa/Apartment) from and against any and all costs, expenses, damages, lawsuits, and/or liabilities or claims arising whether directly or indirectly from or related to any and all claims made by or against any of the released party due to injury, loss, or death from or related to COVID-19.
You agree to immediately notify the accommodation should you or anyone in your party experience symptoms that of fever, fatigue, difficulty breathing, dry cough, headaches, or exhibiting any other symptoms relating to COVID-19 or any communicable disease within a 14 day period prior to the date of your arrival.
USE: The Guest hereby undertakes and agrees that the premises shall be occupied solely and exclusively as a self-catering holiday residence and that no business or profession shall be conducted therein. Guests shall not allow the Premises or any portion thereof to be used or occupied by any person other than the persons named on this form.
VACATING OF PREMISES: Guests undertake that on the termination of their occupancy, they will vacate the premises and deliver it to the owner or agent in a proper condition and in the same good order as received at the commencement of their occupancy.
COMPLIANCE WITH APPLICABLE LAW: Guests shall not commit or allow on the premises any act in contravention of any applicable laws or regulations.
INSPECTIONS AND VIEWINGS: The owner or agent shall have the right to inspect the interior of the premises, by reasonable prior notice. The guests shall permit viewings of the premises at all reasonable times and by reasonable prior notice.
DISPUTE DURING OCCUPANCY: In the event of the OWNER or AGENT canceling this lease and the guests disputing the OWNER or AGENTS right to cancel and remaining in occupation of the Premises, the guests shall, pending settlement of such dispute either by negotiation or litigation continue to pay rental provided for in this occupancy agreement and the OWNER or AGENT shall be entitled to accept and recover such payments and the acceptance thereof shall be without prejudice to and shall not in any way whatsoever effect the OWNER or AGENTS claim for cancellation then in dispute.
SALE OF PROPERTY: In the event of the premises being sold before the guests is to occupy the property, or while the guests is in occupation of the premises, the agent will either move the guests to a property of equal standard, if available, or be entitled to terminate the guests occupancy provided that the guests shall be entitled to a pro-rata refund of rental paid.
BREACH, APPLICABLE LAW, JURISDICTION AND LEGAL COSTS: In the event of the guests failing to pay the rental due hereunder on the due date thereof, or commit a breach of any of these terms and conditions, the owner or agent shall have the right to give written notice to the guests requiring him to pay the rental or remedy such breach, as the case may be, within a reasonable time, where after the agent shall have the right to terminate the occupancy of the premises by the guests and to retake possession of the premises without prejudice to any claim which the agent or the property owner may have for rent and/or damages The guests hereby consents to the jurisdiction of the Magistrates Court of Cape Town. The laws of South Africa govern this occupancy agreement. The guests shall be liable for the owner and/or agents legal costs on a scale as between attorney and own client in the event that the owner or agent has to take legal action to enforce the guests obligations hereunder.
